Many people talk about “the patent” protecting a pharmaceutical product. In reality, successful small molecule products are rarely protected by a single patent.
What often creates real market exclusivity is a patent position.
For the same active ingredient, you may encounter patents covering:
- The compound itself
- Specific polymorphs
- Salts and co-crystals
- Formulations
- Manufacturing processes
- Dosing regimens
- New medical uses
- Combination therapies
Each individual patent may have weaknesses. But together they can create a significant barrier to entry.
This is why generic companies perform detailed freedom-to-operate analyses years before launch. And it is why innovators should think beyond the first composition-of-matter filing.
The strongest protection strategy is often not about obtaining one broad patent. It is about building a coherent portfolio that supports the product throughout its lifecycle.
When evaluating a small molecule asset, I always find it useful to look at the entire patent landscape; not just the headline patent.
