    Privacy Statement

    Algemeen Octrooi en Merkenbureau B.V., hereinafter referred to as AOMB, with its registered office and principal place of business at Vestdijk 51, 5611 CA Eindhoven, registered with the Chamber of Commerce under number 17074382, values the protection of your personal data highly. In this Privacy Policy we want to provide clear and transparent information about how we handle personal data. 

    We do everything we can to guarantee your privacy and therefore handle personal data with care. AOMB complies in all cases with applicable laws and regulations, including the General Data Protection Regulation. This means that we at least: 

    • Process your personal data in accordance with the purpose for which it was provided, these goals and type of personal data are described in this Privacy Policy;
       
    • Processing of your personal data is limited to only those data that are minimally necessary for the purposes for which they are processed;
       
    • Ask for your explicit consent if we need it for the processing of your personal data;
       
    • Have taken appropriate technical and organizational measures to ensure the security of your personal data;
       
    • Do not pass on personal data to other parties, unless this is necessary for the purposes for which they were provided;
       
    • Are aware of your rights regarding your personal data, and to respect these rights.
       

    As AOMB we are responsible for the processing of your personal data. If, after reading our Privacy Policy, or in a more general sense, you have questions about this or wish to contact us, you can do so via the contact details at the bottom of this document. 

     Processing of personal data of Clients 

    Personal data of Clients are processed by AOMB for the following purpose(s):  

    • Administrative purposes;
       
    • Communication about the assignment and/or invitations;
       
    • Executing or issuing an order.
       

    The basis for this personal data is: the agreed assignment. The work to be performed by AOMB, which has been commissioned by the Client, may entail the sharing of personal data of inventors, applicants, contact persons and others who are related to the Client or its representative. In order to properly perform its duties, to provide IP services at the request of the Client and to meet applicable formal requirements, AOMB must process personal data of individuals related to the Client. With respect to obtaining, defending, maintaining, transferring or commercializing Client's IP rights, Client authorizes AOMB to use relevant personal data in the provision of IP services and to forward said data to official IP authorities or to foreign IP law firms engaged by AOMB whenever necessary to obtain, defend, maintain, transfer or commercialize the Client's IP rights, domestically or abroad.  

    The Client and AOMB acknowledge that all data processing related to the acquisition, defense, maintenance, transfer or commercialization of the Client's IP rights is in accordance with rules imposed by official IP authorities and that these data are necessary for the proper provision of IP services.  

    Your personal data will be stored by AOMB for the above processing(s) for the period:  

    • During the period that we manage your IP rights and thereafter in the financial administration on the basis of legal requirements.
       

    Processing of personal data of Suppliers 

    Personal data of suppliers are processed by AOMB for the following purpose(s):  

    • Administrative purposes;
       
    • Communication about the assignment and/or invitations;
       
    • Executing or issuing an order. 

    The basis for this personal data is: the agreed assignment. AOMB collects data from contact persons of organizations that supply goods and/or services to it. The data that AOMB processes is business contact details such as your name, email address, telephone number and company details. AOMB can therefore enter into a business relationship with you by purchasing products and/or services from you. Your data will only be processed after your consent, for the execution of agreements and if there is a legal obligation and/or on the basis of a legitimate interest of AOMB.

    Your personal data will be stored by AOMB for the above-mentioned processing(s) for the period:

    • During the period that we manage your IP rights and thereafter in the financial administration on the basis of legal requirements. 

     

    Processing of personal data of newsletter subscribers 

    Personal data of newsletter subscribers are processed by AOMB for the following purpose(s):  

    • Informing the person by means of news releases.
       
    • The basis for this personal data is: The newsletter registration form;
       

    Your personal data will be stored by AOMB for the above processing(s) for the period:  

    • During the period of registration. 

     

    Processing of personal data of prospect and/or interested party 

    Personal data of prospect, stakeholder/lobby contacts and/or interested parties are processed by AOMB for the following purpose(s):  

    • Information provision in the form of newsletters and/or targeted communication. 

     

    The basis for this personal data is: verbal consent, providing a business card and/or via a link on Social Media;  

    Your personal data will be stored by AOMB for the above processing(s) for the period:  

    • During the period that you are seen as a prospect and/or interested party and have not indicated that you do not wish to receive our information. 

    Processing of personal data of applicants and (former) employees 

    Personal data of applicants and (former) employees are processed by AOMB for the following purpose(s):  

    We use the collected personal data exclusively for the purposes for which the personal data were provided to us and therefore insofar as necessary for the performance of the relevant employment and related purposes.  

    If you are an employee of AOMB, then AOMB refers you to the Privacy Policy for employees that is included in the AOMB Employee Handbook.  

    The personal data of applicants are recorded via the website www.aomb.nl for the following purpose: Filling in open vacancies  

    AOMB processes data of persons who have indicated that they have applied for a job with it. The name and address details, CV and letter of motivation are forwarded to the vacancy holder and the HR manager. AOMB processes data from applicants to carry out the application procedure, so that it can be determined whether applicants will be hired. 

     Within the EU 

    We do not provide personal data to parties located outside the EU.  

    Minors 

    We only process personal data of minors (persons under the age of 18) if written permission has been given by the parent, caregiver or legal representative. 

     Retention period 

    AOMB does not store personal data longer than necessary for the purpose for which it was provided or as required by law.  

    Security 

    We have taken appropriate technical and organizational measures to protect your personal data against unlawful processing. All persons who can take note of your data on behalf of AOMB are bound to observe confidentiality. 

     Rights regarding your data 

    You have the right to inspect, rectify or delete personal data that we have received from you. You can also object to the processing of your personal data (or part of it) by us or by one of our processors. You also have the right to have the data provided by you transferred by us to yourself or on your instructions directly to another party. We may ask you to identify yourself before we can comply with the aforementioned requests. 

     If we are allowed to process your personal data on the basis of permission given by you, you always have the right to withdraw this permission.  

    Complaints 

    If you have a complaint about the processing of your personal data, we ask you to contact us directly. If we cannot find a solution together with you, we will of course find this very annoying. You always have the right to submit a complaint to the Dutch Data Protection Authority, which is the supervisory authority in the field of privacy protection.
