Plant variety rights are valid for up to 25 or 30 years in the Netherlands and are available at the Council for Plant Breeders' Rights in Wageningen. To obtain breeder's rights, your plant species must meet four requirements. It must be new, uniform and stable. And distinguishable from previous types.
You can also protect your rights across Europe. For this you must apply to all EU Member States in the Community Plant Variety Office in France.
If your request is approved you will be granted breeder's rights.
In that case, you can also grant third party licensing against payment, the right to produce your breed, sell or breed. This can be done by means of a license.
